This morning at 7:15, minding my own business, sat in my car about four cars back waiting to pull out onto a roundabout and a dozy cow goes into the back of my car. It was 2 degrees above but the road wasn't icy just damp.
Big F-ing red estate and I'd been stationary for 2 or 3 seconds.
I jump out and approach the Woman to discuss what she just did when her words were "you braked too late." I said "I was stationary, I wasn't even moving, the car was still for at least 2/3 seconds." I then said don't you try blaming me you stupid cow" or similar. She then said " what do you want to do?" I said " I want your name address and insurance details."
See couldn't write my name down even after me spelling it three or four times and it's only six letters and not hard so I did it. When she saw the address she said "@@@@, East Yorkshire? What are you doing here?" As if my address was Mars and I was not supposed to be on her planet. I only live ten miles from work. I said " I'm on my way to work, where are you going?"
Anyway she carried on muttering and looking at the ground saying I braked too late like she needed the last word so I told her to go away using a popular phrase.
The reason for the title is because I was in Hull and her second name was Pickering.
Back in the good old days plod would even hand out endorsement to people who fell off bikes and only injured themselves. I know I was one who got a driving without due care. Nowadays as long as you stick to 30mph nothing is ever going to happen to you until you kill someone. The only thing you can do is make them pay financially which I will try my best to do.
The roads are full of ar$eholes and I seem to attract them. The last one was my R1, different roundabout though.

She has no defence, even if you had braked sharply, there is no defence for a rear ender, you should always be able to stop before hitting the vehicle in front, or its driving without due care and attention, at least.

Yep, what Tony said.
She has no defence for running into the back of you, stationary or not, hard braking or not.

I wrote a post about being rear ended on the R1 and mentioned how many times in my 42 years of having a car driving license it happened. What surprised me was how many people mentioned the braking hard bit. Someone even said that it sounds like youre a bit of a late breaker!
I don't brake hard or late in my car on the road ever unless it's required. I save late braking for use at Cadwell on the RGV as the only means of getting past bikes with up to three times the power.
I'll list the six times I have had cars going into the back of me.
Ford Orion sat at traffic lights for maybe ten seconds. Someone drives into me. Fitted with towbar so loads of damage to his car. None to mine
Vauxhall Vectra, sat in a long que of maybe twenty cars right outside work and moving every 20/30 seconds. Someone goes into the back and said "I thought you moved." Towbar so same again.
Same Vectra. Walking back to my car with Motorcycle News just bought and in my hand. Woman in a BMW reverses into it when reversing to pull out. There was loads of space to park elsewhere but she chose to park in front of my car. Same towbar. Big hole in (her Husbands cars) front bumper. She's upset about what her husband will say.
R1 sat at the front of the roundabout waiting to join. Been sat there at least ten seconds. Woman runs into the back saying "I thought you'd gone." It's an R1, it does 0 to 60 in about 3 seconds. If there was a safe gap I would have gone.
Then this one. There was no late or hard braking involved. Just foot off the accelerator pedal, gentle brake pressure, stop, sit there, one, two, three, bang.
How on Earth are any of those my fault?
My Mr's had two crashes involving her Corsa. Number one was a guy being guided reversing out of a drive then went straight into the side of her car as she was walking towards it. Number two was three guys in a stolen Transit. Came around the corner, slid and took her wing mirror straight off. £350 repair. Oh and this hit and run driver cover? Only pays out if they are caught so as much use as tits on a nun.

The roundabout where that took place is on my drive to work and back every day. Apparently someone put a blue plaque up where the second set of discussions took place but it soon disappeared so I was told Funnily enough, or maybe not, my Sister in Law knows this guy. Her and her man frequent the same pub. He's a very, very, very, minor celebrity. When I sent my Mrs a message she said his partner is called Karen so it's not his other half. Would be a laugh if it was . It could though be that she is a "karen"which I understand is a different thing altogether Her insurance company, Direct Line, contacted me today and said that their client has admitted responsibility. I replied well she had to didn't she? They want me to let them sort the car etc. out. No is the answer to that one.

The payout is sometimes less if you don’t let them sort it

This is why we have a 2 second rule, reaction time, if someone can't stop if you do, then they are either not paying attention = driving without due care, or they are driving too close to the vehicle in front = careless driving, there is no excuse, its that simple, you are not at fault, don't let anyone tell you different.

It's one of my many pet hates is people driving like they're trying to get into my boot. It's not like I drive at 35 in a 60 or even 35 in the outside lane of a dual carriageway with a 40 limit like my Mrs. does

It is quite simple.. you have to leave sufficent distance to the vehicle in front to have time to brake safely in any situation. If you hit someone up the ass its your fault.full stop.
Ive been shunted hard on the motorway in a pile up 20 odd years ago.. the dumbass bird that hit me could have stopped in time but was chatting to her mate.. not paying attention. I was paying attention and had stopped in plenty of time to the cars in front. I even gave space to the car infront trying to mittigate the situation and she still punted me into it..
Coincidentialy the police were parked opposite .. she got out saying id stopped too quickly ..the copper laughed at her and told her bollocks.
Ruined my neck for life.
